 Privacy Statement for the MISS Scheme (“Scheme”) 

WHAT THIS PRIVACY STATEMENT COVERS 

This privacy statement explains how personal information is collected, used and disclosed by or on behalf of the MISS Scheme Trustees (“Trustee”), including by the administration manager of the Scheme, currently Mercer (N.Z.) Limited (“Mercer”). It also sets out how to request access to, and correction of, your personal information, and who to contact for further information. 

The Trustee collects personal information from or about:

  • members of the Scheme (‘Members’); and 

  • their nominated beneficiaries (‘Beneficiaries’), 

in connection with the Trustee’s administration of the Scheme and its benefits. References in this privacy statement to “you’ and “your” are references to Members and/ or Beneficiaries in respect of whom personal information is about. 

Mercer may collect personal information in relation to the Scheme on behalf of the Trustee (as the Trustee’s agent) when carrying out administration services for the Trustee. References in this privacy statement to ‘we’, ‘our’, or ‘us’ are references to the Trustee and/or Mercer, when acting as the Trustee’s agent to collect, disclose, use and otherwise process personal information on the Trustee’s behalf. 

HOW WE COLLECT PERSONAL INFORMATION 

We may collect personal information about you in the following circumstances: 

  • when you communicate with us. 

  • when you authorise us. 

  • when you provide or update your personal information. 

  • when you respond to our requests for your personal information; and 

  • when you contact us for any reason. 

We may also collect personal information about you for the purposes set out in this privacy statement from Mercer, or another third party that you have authorised to provide the information to us (such as your employer, the Scheme’s insurer, your doctor or medical professional, your legal adviser, your union representative or Beneficiaries), and as otherwise permitted by law. 

We may collect personal information about your Beneficiaries from you for the purposes set out in this privacy statement (e.g., name, date of birth, contact details and bank account details). 

If you provide us with personal information about a third party (such as your Beneficiaries or any person you appoint to act on your behalf), you must ensure you are authorised to provide that information to us, and by providing that information to us, you confirm you have that authorisation.

WHAT PERSONAL INFORMATION WE COLLECT 

The categories of personal information that we collect about you include: 

  • name, date of birth, bank account details, IRD number, employee number and contact details (for example, address, phone number and email address); 

  • information about your employment and remuneration. 

  • other information we require in order to manage and administer the Scheme in accordance with the Scheme trust deed and/ or applicable law; and 

  • any other information that you may provide to us (or authorise to be provided to, or collected by, us) from time to time, including:
    - information about your health and wellbeing. 
    - information that we require to calculate and/or arrange for payment of benefits due to you and calculate the employer  contributions you are entitled to receive under the Scheme. 

THE PURPOSES THE TRUSTEE USES YOUR PERSONAL INFORMATION FOR 

We may collect, use, hold and disclose your personal information for the following purposes: 

  • managing and administering the Scheme. 

  • managing and administering your membership to the Scheme. 

  • taking out, maintaining, administering, and managing insurance policies and managing our relationships with insurers and other third parties that provide insurance benefits. 

  • maintaining and updating our and the Scheme’s records. 

  • identifying and communicating with you (including responding to queries and requests). 

  • managing the Trustee’s relationship with you. 

  • complying with law, including ensuring benefits under the Scheme are calculated and paid correctly. 

  • where use of the information is necessary to protect our rights and interests, for example in relation to a legal claim or a regulatory enquiry. 

  • any other purpose that we notify you of at the time (or as soon as practicable after) your personal information is collected, or for any other purpose you may otherwise authorise us to use your personal information; and 

  • any other purpose permitted by law. 

WHO WE MAY SHARE YOUR PERSONAL INFORMATION WITH 

We may share your personal information:

  • with the Scheme's administrator, our advisers (such as the Scheme actuary and legal counsel) and other service providers who we may engage from time to time (such as Mercer, AIA New Zealand, Marsh New Zealand), in order to facilitate the administration of the Scheme and the calculation and payment of your benefits. 

  • with Inland Revenue and other Government agencies where required by law

  • with other third parties (e.g. to your current or former employer to assist them in making decisions relevant to their role as a participating employer of the Scheme, your financial advisor), to the extent reasonably required to carry out any of the purposes for which we may use your personal information (set out above) and/ or if you have requested or authorised this.

  • with Beneficiaries if necessary for the administration of benefits. 

  • if we are requested to do so in the course of legal proceedings or other investigations; or 

  • if authorised by you or where we are otherwise required or permitted to do so by applicable law. 

THE CONSEQUENCES IF YOU DO NOT PROVIDE US WITH YOUR PERSONAL INFORMATION 

If you do not provide us, or authorise us to collect, the personal information we have requested or may require from time to time, we may be unable to provide certain Scheme services to you. For example, we may be unable to calculate and/or arrange for the payment of benefits due to you under the Scheme or respond to your queries and requests. 

HOW LONG WE HOLD YOUR PERSONAL INFORMATION FOR 

We may retain your personal information for as long as required to carry out any of the purposes for which we may use your personal information contemplated in this privacy statement. 

LINKS TO THIRD PARTY WEBSITES IN OUR DOCUMENTS AND COMMUNICATIONS 

Scheme documents and/or communications that we have with you may contain links or references to third party websites. Unless expressly stated otherwise, those websites have not been developed by, and are not controlled by, us. They are provided for your convenience only, and their provision does not imply that we check, endorse, approve or agree with the privacy practices of those third-party websites. We encourage you to read the privacy statements of each third-party website you visit. 

HOW YOU CAN REQUEST ACCESS TO AND CORRECTION OF YOUR PERSONAL INFORMATION 

You have the right to request access to, and correction of, the personal information we hold about you.

This privacy statement may be updated at any time.  

When changes are made to the Privacy Statement, the updated version will be made available on the Scheme’s website www.miss.org.nz. Any such changes will be effective immediately upon posting. Your continued participation in the Scheme following any update will constitute your acceptance of the updated privacy statement.
